Judge Tells Broadcom of second chance to sue Qualcomm
A federal judge told Broadcom it must decide whether it would like to pursue its charge that rival Qualcomm deliberately violated its patents. U.S. District Judge James Selna overturned a $39.3 million award against Qualcomm, because an Appeals court just made it more difficult to prove intentional patent infringement. Now, if a jury does find that a company has committed deliberate patent infringement, a judge could triple the damages. In May, a jury ruled that Qualcomm had violated three of Broadcom’s patents for technologies that help mobile phones process video, PTT and others.
